ENCODED Terms of Service

Entity: ENCODED LLC, a Delaware limited liability company (“ENCODED,” “we,” “us,” or “our”)

By accessing or using ENCODED’s websites, applications, products, programs, or services (collectively, the “Services”), you (“you,” “Member,” “user,” or “customer”) agree to these Terms of Service. Please read carefully.

1. Eligibility

• You must be at least 18 years old to enroll or use ENCODED Services.
  
  
• By registering, you confirm that all information provided is accurate and that you meet this requirement.
  
  

2. Description of Services

ENCODED provides personal development, education, and digital training programs designed to enhance clarity, stability, and performance through the practice of Frequency Training.
Our Services include, but are not limited to:

• ENCODED Membership (recurring subscription)
  
  
• Frequency Mapping & Activation (one-time onboarding)
  
  
• ENCODED Mirror (Web + Mobile)
  
  
• ENCODED Anchor Journal (physical and digital)
  
  
• The Frequency Network (member community)
  
  
• Certified Frequency Trainer programs and related educational experiences
  
  

ENCODED is not a medical, psychological, therapeutic, or financial provider. Our content and programs are educational and experiential in nature.

3. Membership, Payments & Billing

• Activation Fee: A one-time, non-refundable payment due at enrollment. This covers your personalized Frequency Mapping, onboarding, and initial setup of your ENCODED system.
  
  
• Membership Fee: Recurring subscription billed every 30 days (or as otherwise stated at checkout).
  
  
• Renewal: Membership renews automatically each billing period until cancelled. You may cancel your membership anytime before your next billing cycle to prevent renewal.
  
  
• Non-Use Policy: Failure to use the Services does not pause, credit, or cancel your payments.
  
  
• Price Changes: We may adjust pricing with notice before your next billing cycle. Continued membership constitutes acceptance.
  
  

4. Cancellation & Refunds

• Activation Fees are non-refundable.
  
  
• Membership fees are non-refundable once a billing cycle has started.
  
  
• Cancellations made before the next billing cycle will stop future charges.
  
  
• No prorated or partial refunds will be provided for unused time.
  
  

5. Member Standards

As an ENCODED Member, you agree to:

• Maintain a respectful, harassment-free environment in all ENCODED spaces.
  
  
• Keep all member information confidential.
  
  
• Use the ENCODED System solely for your own training and growth unless formally certified as a Trainer.
  
  
• Avoid unsolicited marketing, self-promotion, or external business solicitation in any ENCODED community or group.
  
  

Violation of these standards may result in account suspension or termination without refund.

6. Trainers, Partners, and Third Parties

• Certified Frequency Trainers operate as independent professionals and are not employees or agents of ENCODED LLC.
  
  
• ENCODED is not responsible for any advice, claims, or results from third-party trainers or affiliates.
  
  
• Members may not present themselves as Trainers or use ENCODED branding commercially without written authorization.
  
  

7. Intellectual Property

• All ENCODED materials, methods, designs, software, branding, and technology are the exclusive property of ENCODED LLC.
  
  
• You receive a limited, non-transferable, personal license to use these materials during your active membership.
  
  
• Copying, distributing, modifying, or using ENCODED intellectual property outside your personal membership is strictly prohibited.
  
  

8. Technology, Data & AI Services

• ENCODED uses digital and AI-assisted tools to deliver personalized experiences. This may include analysis of your journal entries, activity data, and feedback.
  
  
• AI-generated insights are for personal growth and educational purposes only and should not be treated as professional advice.
  
  
• Your personal data will never be sold or shared publicly. It is used solely to enhance your experience and improve the ENCODED System.
  
  
• You are responsible for maintaining the confidentiality of your login credentials and devices.
  
  
• We are not liable for interruptions caused by internet connectivity, third-party services, or device issues.
  
  

9. Data Security & Privacy

We take data protection seriously.

• All personal information, journal entries, and activity data are encrypted and stored securely using industry-standard safeguards.
  
  
• Sensitive data is accessible only to authorized systems and personnel for the purpose of delivering and improving ENCODED Services.
  
  
• ENCODED follows data protection principles consistent with major privacy laws (including GDPR and CCPA) to ensure fairness, transparency, and control over your personal information.
  
  
• Members may request correction or deletion of their data by contacting support@encoded.ai.
  
  
• In the unlikely event of a data breach, ENCODED will notify affected users and relevant authorities promptly in accordance with applicable law.
  
  
• While we take reasonable measures to protect your information, you acknowledge that no system is completely immune to unauthorized access.
  
  

10. Disclaimers

• ENCODED is not a substitute for professional medical, psychological, or therapeutic treatment.
  
  
• Results vary by individual and depend on your engagement and consistency.
  
  
• While our systems are designed for measurable progress, we make no guarantee of specific outcomes or transformations.
  
  

11. Limitation of Liability

To the fullest extent permitted by law:

• ENCODED is not liable for indirect, incidental, or consequential damages arising from your use of the Services.
  
  
• ENCODED’s total liability shall not exceed the total amount paid by you in the three (3) months prior to the claim.
  
  

12. Indemnification

You agree to indemnify and hold harmless ENCODED LLC, its founders, officers, trainers, and affiliates from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.

13. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Delaware, USA.
  
  
• Any dispute will be resolved by binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association (AAA).
  
  
• You waive any right to participate in class actions or collective proceedings.
  
  

14. Updates to Terms

ENCODED may update these Terms periodically. Updated versions will be posted on our website with a revised effective date. Continued use of Services indicates acceptance of changes.
